Driver Terms & Conditions
Applies to the OTPCabs Driver App. Operated by OTP CAB SERVICE PRIVATE LIMITED.
These Terms & Conditions ("Terms") govern your use of the OTPCabs Driver App and your participation as a driver on the platform operated by OTP CAB SERVICE PRIVATE LIMITED ("OTPCabs", "we", "us", or "our").
These Terms apply to drivers only. Customers and vendors are governed by separate terms available on this website.
1. Driver Eligibility
- You must be at least 18 years old (or the minimum age required for commercial driving in your state) and legally permitted to work as a driver in India.
- You must hold a valid driving licence appropriate for the vehicle you drive.
- Your vehicle must have valid registration and comply with applicable motor vehicle laws, including insurance and permits where required.
2. Registration, OTP Authentication, and KYC
You register with your mobile number, verified by a one-time password (OTP). You must complete KYC verification, including PAN and driving licence submission, and vehicle verification including RC details, before receiving rides.
All documents and information you submit must be accurate, current, and belong to you. Submitting false, forged, or another person's documents results in immediate account action and may be reported to authorities.
3. Driver Account, Online Status, and Ride Requests
Your driver account is personal. Account sharing — letting another person drive under your account — is strictly prohibited. Operating multiple driver accounts is prohibited.
When you go online, you signal availability and may receive ride requests based on your location, vehicle category, and platform rules. You may accept or reject requests, and may make offers where the bidding system applies. Excessive rejection or cancellation after acceptance may affect your standing on the platform.
4. Pickup, OTP Start, Active Trip, and Completion
- Proceed to the pickup point promptly after accepting a ride.
- Start the trip only after entering the customer's ride-start OTP with the customer present in the vehicle.
- Follow a reasonable route using in-app or approved navigation during the active trip.
- Complete the trip in the app at the drop point so the fare is calculated correctly.
5. Fare Collection, Earnings, Fees, and Payouts
Collect fares only as shown in the app — in cash, or through online payment where the customer pays digitally. Do not demand amounts above the app fare except charges the app itself displays (such as tolls or parking actually incurred).
Your earnings, platform fees, and any commission are shown in the app. Where a wallet applies, you may need to maintain a minimum balance as communicated in the app.
Settlements and payouts are made to your verified bank account. Bank details must pass verification before payouts are processed. Fraudulent or disputed amounts may be withheld during investigation.
6. Driver Conduct and Customer Safety
- Treat customers with courtesy and professionalism. Harassment of any kind is strictly prohibited.
- No discrimination against customers on any grounds, including destination-based refusal after acceptance except where genuinely unsafe.
- Zero tolerance for driving under the influence of alcohol or drugs.
- No dangerous or rash driving. Comply with all traffic laws, signals, and speed limits.
- Keep your vehicle clean, roadworthy, and in the condition and category declared on the platform.
- Protect customer data: use customer contact details only to coordinate the trip, never for personal contact afterwards.
7. Location Tracking
By going online you agree that the app tracks your GPS location, including in the background where you have granted that permission, as described in the Driver Privacy Policy. Location tracking is required for ride matching, customer safety, and fare accuracy. Disabling location while online may prevent ride assignment.
8. Prohibited Activities
- Creating fake trips or simulating rides to earn incentives.
- Manipulating GPS (location spoofing) in any form.
- Operating multiple accounts or sharing your account with any other person.
- Abusing the cancellation system to manipulate fares or incentives.
- Collecting or misusing customer personal data.
- Carrying unauthorised passengers or goods during platform trips.
9. Insurance, Permits, and Legal Compliance
You are responsible for maintaining valid vehicle insurance, permits, fitness certificates, and any other documents required by applicable Indian motor vehicle laws for commercial passenger transport in your state.
You are an independent service provider, not an employee, agent, or partner of OTPCabs. You are responsible for your own tax obligations.
10. Accidents, Emergencies, and Complaints
Report accidents, safety incidents, or emergencies during a platform trip to local authorities where appropriate and to OTPCabs support as soon as reasonably possible.
We investigate customer complaints fairly. You agree to cooperate with investigations; your account may be restricted during a serious investigation.
11. Suspension, Restriction, and Termination
We may restrict, suspend, or terminate your driver account for violation of these Terms, document expiry or failure of re-verification, safety complaints, fraud, or unlawful activity, with notice where practicable.
You may stop driving on the platform at any time and may request account deletion as described in the Driver Privacy Policy. Pending settlements are completed per the payout process after any lawful deductions.
12. Limitation of Liability
OTPCabs provides technology to connect you with customers and does not guarantee any minimum number of rides or earnings. To the maximum extent permitted by law, OTPCabs is not liable for indirect, incidental, or consequential losses arising from your use of the platform.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date shows the latest revision. Material changes will be notified through the app or other reasonable means. Continued use after changes take effect means you accept the updated Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of India, including applicable motor vehicle laws. Subject to any mandatory law, courts at Bengaluru, Karnataka have exclusive jurisdiction. Please raise disputes with our grievance team first so we can try to resolve them directly.
